There are many types of discrimination that are well known – race discrimination, gender discrimination, religious discrimination – but there are other, less well recognized, bases for discrimination which are important to understand.
EEOC v. Founders Pavilion Inc. was only the third suit brought by the EEOC under the Genetic Information Nondiscrimination Act (GINA), which was passed in 2008. The employer, a NY nursing and rehabilitation center, was engaged in a systemic practice of requesting family medical history as part of its post-offer, pre-employment medical exam of applicants.
The case settled before going to trial for $370,000. But more important than the amount is the increased awareness about GINA the case is providing. David Lopez, EEOC General Counsel, stressed in the commission’s press release “Employers need to be aware that GINA prohibits requesting family medical history.”
